Kay Flock has been found guilty in the RICO case against him and the gang he is alleged to be part of, Sev Side.
On Thursday (March 20), on the second day of deliberations, the jury returned “mostly—but not all—guilty verdicts,” according to Inner City Press, which has been reporting on the court proceedings over the past few weeks.
All in all, the New York rapper, born Kevin Perez, was acquitted on charge of murder in aid of racketeering but was found guilty on several others, including racketeering conspiracy, use of a firearm resulting in death, attempted murder and assault with a dangerous weapon in aid of racketeering and use of a firearm for attempted murder and assault with a dangerous weapon.
According to Inner City Press, sentencing is scheduled for July 16.
“Kevin Perez, a/k/a “Kay Flock,” was the leader of a neighborhood street gang known as Sev Side / DOA, and with that gang, he committed a series of gang-motivated shootings,” Acting U.S. Attorney Matthew Podolsky of the U.S. Attorney’s Office, Southern District of New York said in statement. “Perez, a drill rapper, instilled fear across the community with his violent actions, and then threatened rivals, bragged about shootings, and taunted victims in his rap lyrics. But as a unanimous jury has now found, Perez can no longer hide behind his music, and instead will be held to account for his violent crimes. Thanks to the hard work of the career prosecutors of this Office and our law enforcement partners, the cycle of violence that Perez engaged in is over. This Office remains resolute in its commitment to prosecuting gang members who sow fear and spread violence on our city streets.”
Flock, along with Devon Mason, Ervin Beamon, Nicholas Johnson, Jossi Castro, Iszayah Rowson, Mitchell Grant and Sean Smith, were accused of being responsible for a murder and several shootings in The Bronx area from 2020 to 2022. One of the main crimes at the center of the case is the murder of 24-year-old Hwascar Hernandez, who was shot outside of a Harlem barbershop on Dec. 16, 2021. According to the NYPD, Hernandez was shot in the neck and back after running out of the barbershop as Flock walked by. The rapper’s attorneys claimed the shooting was in self-defense.
